Terms and Conditions of Use

1. WIRELESS SERVICES

1.1 In subscribing to the STL’s service of information upon request (hereinafter called the ??oeservice”), you accept the conditions set forth in this agreement, on use of this service, with the STL and its partner TBA (the ??oeservice providers”).

1.2 The service providers reserve the right to amend this agreement in whole or in part, at any time, and agree to publish the new rules on use, on the website of the service, or to directly sent them to the users by e-mail.

1.3 IF YOU DO NOT AGREE WITH THE RULES SET FORTH IN THIS AGREEMENT, OR WITH ANY AMENDMENT SUBSEQUENTLY MADE THERETO, YOU MAY CANCEL YOUR SUBSCRIPTION AT ANY TIME BY DEACTIVATING YOUR ACCOUNT OR BY SENDING THE SERVICE PROVIDERS AN E-MAIL REQUESTING THE CANCELLATION OF YOUR SUBSCRIPTION. BY CONTINUING TO USE THE SERVICE IN ACCORDANCE WITH THE CURRENT TERMS AND CONDITIONS, OR FOLLOWING PUBLICATION OF A NOTICE OF AMENDMENT TO THE CONDITIONS, YOU ARE CONFIRMING THAT YOU ACCEPT THE RULES ON USE OF THIS SERVICE, OR THE CHANGES MADE THERETO, AS THE CASE MAY BE.

1.4 SENDING ANY TEXT MESSAGE BY MEANS OF THIS SERVICE MEANS THAT YOU ACCEPT THE TERMS AND CONDITIONS OF USING THE SERVICE AND THE WEBSITE AS WELL AS THE POLICY ON CONFIDENTIALITY POSTED ON THIS SITE.

1.5 The service providers also reserve the right to amend, suspend or remove any aspect of the service, at any time, including the functionalities or contents of the service. They may also impose restrictions on using the functions and services offered or limit access to the service, in whole or in part, without advance notice, and they disclaim any and all responsibility for damage or losses that may result from these measures.

2. CONTENTS

2.1 The contents disseminated on the service are intended for personal, and not commercial, use. Any information that is accessible through the service (the ??oecontents”) is protected by copyright and remains the property of the service providers, which control it. You must comply with all the notices, information and restrictions that form part of the contents.

2.2 The service and its contents are protected by Canadian and international copyright laws; consequently, it is prohibited to amend, publish or send the contents obtained by the service, to take part in transferring or selling these contents, to reproduce them, to include them in new creations, to distribute them, to execute them in public, to post them or to exploit them in any way, in whole or in part.

3. LIMITATIONS OF LIABILITY

THE SERVICE AND ITS CONTENTS ARE PROVIDED ??oeAS IS”, WITHOUT ANY EXPRESS OR IMPLICIT WARRANTY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, OF MERCHANTABILITY AND OF CAPABILITY FOR A SPECIFIC USE. YOU HEREBY ACKNOWLEDGE ASSUMING ALL RISKS RELATING TO THE USE OF THIS SERVICE. THE SERVICE PROVIDERS MAY NOT BE HELD RESPONSIBLE FOR THE DELAYS, INACCURACIES, ERRORS OR OMISSIONS OF ANY NATURE WHATSOEVER THAT MAY IMPAIR THE CONTENTS, TRANSMISSION OR RECEIVING OF ALL OR PART OF THIS INFORMATION, AND THEY HOLD THEMSELVES HARMLESS FROM ANY AND ALL RESPONSIBILITY WITH REGARD TO THE DAMAGE THAT MAY RESULT THEREFROM.

4. REGISTRATION AND SECURITY

4.1 When you register for the service, you must choose a password and provide certain personal information, which must be accurate and up to date. You are not allowed (i) to choose or use the password of another user with the intention of committing identify theft; (ii) to use a password whose rights belong to another person, without that person’s prior authorization; or (iii) to choose a password that the suppliers, at their sole discretion, consider offensive. Any failure to comply with the above-mentioned rules constitutes a violation of the agreement, which may result in immediate closure of your account as a subscriber to this service.

5. PROCEDURES FOR USE

5.1 To use the service, you must give the service providers your name and other information necessary for its use. It is strictly prohibited to subscribe to this service using another person’s identity. Any failure to comply with this rule constitutes a violation of these terms and conditions of use and may result in withdrawal of your access privileges for this service.

5.2 In accordance with the terms and conditions set forth herein, you agree not to send any messages including any illegal or defamatory content or that has any ill effects on the private lives of others, or which, in the opinion of the service providers, is detrimental, vulgar, obscene, disrespectful, pornographic or abusive, harassing, threatening or containing remarks that are hateful or inadmissible with regard to the race, religion, faith, ethnic origins or sex of a third party, or which, for any other reason, is not considered to be worthy of publication.

6. CHARGES AND PAYMENTS

6.1 The service providers reserve the right to charge, at any time, for accessing all or part of the service. Nevertheless, no access costs will be charged to you if you have not expressly agreed to being billed for the service. In the event that the service should become a paying service, the service providers agree to inform you in advance of any costs that will be charged, so that you can cancel your subscription before the new charges for use come into effect. Please note that your wireless telecommunications service may charge fees for using the messaging service.

7. COMMUNICATIONS

7.1 The service providers reserve the right to communicate with you by e-mail (including by text messaging) to inform you of any changes or new things added to the service.

7.2 The service providers also reserve the right to communicate information to third parties on your socio-demographic profile and on the use you make of the service, as long as this information doesn’t reveal your identity. No one advertising on or operating any websites may collect or exchange any information about your account, without your consent.

8. CANCELLATION

8.1 You may cancel your subscription at any time by deactivating your user account or by e-mailing a request to unsubscribe. If you cancel your subscription, you will have to wait 24 hours before being able to submit another access request.

8.2 The service providers may, at their sole discretion, terminate your privileges of accessing all or part of the service, or temporarily suspend them, for any reason they deem valid, including, but nevertheless not being limited thereto, following a violation or transfer of this agreement.

9. VARIA

9.1 This agreement has been established pursuant to the laws of the province of Québec and must be interpreted and enforced in accordance therewith. Any legal action aimed at enforcing this agreement must be filed with the Québec courts.
